Pennsylvania Workers' Comp: 8th Most Expensive

Pennsylvania ranks 8th among all 51 U.S. jurisdictions for workers' compensation costs, with an index rate of $1.58 per $100 of payroll — 45% above the national median. The state's high rates reflect generous benefit levels, high medical costs in the Philadelphia and Pittsburgh metro areas, and a complex classification system.
Coverage is required for virtually all employers. Pennsylvania has one of the broadest coverage requirements in the nation — even sole proprietors and partners are automatically included unless they formally opt out. Corporate officers are also included by default. The threshold is effectively one employee, with very limited exceptions.

The Classification Challenge

Pennsylvania uses the NCCI classification system, but the state's high base rates mean that classification accuracy is especially important. A misclassified employee can cost you thousands of dollars per year in excess premium.
The most common classification errors we see in Pennsylvania involve construction businesses that combine office and field work, restaurants where servers are classified under the same code as kitchen staff, and professional services firms where different roles carry different risk levels. A proper classification review can often reduce your premium by 10-20% without changing your coverage.

No-Fault Auto: Pennsylvania's Unique System

Pennsylvania is one of roughly a dozen no-fault auto insurance states, but with a twist — drivers can choose between 'full tort' and 'limited tort' options. Full tort preserves your right to sue for pain and suffering after an accident. Limited tort restricts that right (with exceptions for serious injuries) in exchange for lower premiums.
For commercial auto policies, this choice matters. If your employees drive company vehicles, the tort option you select affects both your premium and your exposure. Most commercial policies in Pennsylvania default to full tort, which is more expensive but provides broader protection for your business and employees.
Pennsylvania requires minimum commercial auto liability limits of 15/30/5 — among the lowest in the nation. These limits are dangerously inadequate for any commercial operation. A single serious accident in Philadelphia or Pittsburgh can easily produce claims of $500,000 or more. We recommend at least $1 million CSL for commercial vehicles in Pennsylvania.

Philadelphia vs. the Rest of the State

Insurance costs in Pennsylvania vary dramatically by region. Philadelphia is significantly more expensive than the rest of the state for virtually every line of coverage — workers' comp, commercial auto, general liability, and property. This reflects higher medical costs, more aggressive litigation, and greater population density.
If your business operates in Philadelphia, expect to pay 20-40% more for commercial auto insurance than a comparable business in Harrisburg or Erie. Workers' comp rates are also higher in Philadelphia due to higher medical costs and claim frequency. Budget accordingly and make sure your coverage limits reflect the Philadelphia market, not state minimums.

Tips for Pennsylvania Employers

Given Pennsylvania's high workers' comp rates, every dollar you invest in safety and claims management pays outsized dividends. Request a classification review from your agency — it's free and can identify immediate savings. Explore group self-insurance programs if your business is large enough (typically $100,000+ in annual premium).
For commercial auto, choose the tort option carefully and make sure your drivers understand the implications. Implement a fleet safety program with regular driver training, MVR checks, and telematics if possible. Pennsylvania's no-fault system means you'll pay for your own employees' medical costs regardless of fault, so reducing accident frequency is the most effective way to control costs.
